I believe you're both incorrect. I play it as the side with the higher morale per the scenario instructions. For example, Germans have 8/7 morale while the French have 7/6. If no German units have suffered a step loss, it's 8 to 7/6 and the Germans get the +1 bonus.

It would be more clear if it was worded "both sides unless specifically noted otherwise." For example:
